Liability insurance for damage caused by the operation of SFD in 2024 - according to the Decree

According to insurance contract no.  8079686012 is negotiated liability insurance for damage caused by the operation of sports flying equipment (hereinafter referred to as "SFD") within the scope of VPP AVN 2014, Part C, Article I, Paragraph 1. According to the will of the insured expressed before the individual insurance concluded by this insurance contract in the application for insurance (see Article V of this insurance contract), insurance may be established to the extent also in accordance with VPP AVN 2014, Part C, Article I, Paragraph 2. according to this insurance contract, it also applies to air competitions.

1. According to DECREE 108/1997 Coll. as amended

Insurance possible only for paragliders (PK), hang gliders (ZK), motorized paragliders (MPK) and motorized hang gliders (MZK).

  • Territorial validity for the Czech Republic, the Czech Republic+SR or the whole world outside the excluded territories.
  • Divided according to take-off weight into 3 categories - up to 150 kg, up to 300 kg and up to 499 kg.
  • Can be concluded for the period from payment to 31 December 12 (for the whole year), or for a specifically specified shorter period.
  • In the case of paragliders, the insurance can be taken out for a person or a specific glider.
  • INCLUDES PASSENGER LIABILITY INSURANCE ON BOARD. The insurance does not apply to a family member or household member (see VPP AVN 2014, part E, article 1 point 10).
  • The insurance company requires the insured to apply for insurance either BY WRITTEN APPLICATION, or ONLINE (www.laacr.cz).

* clause AVN 1,5E is part of the limit of 52 million EURO and the territorial scope of the whole world. This clause is exclusively for PK and PK TANDEM aircraft type.

Common provisions for insurance according to decrees i ordinance

The possibility of using a shortened insurance period for insurance according to the DECLARATION

When using the option to arrange insurance for a shorter, specifically determined period, the price of the insurance premium is determined according to the length of the required period by the percentage rate of the annual insurance premium according to the following table:

However, the minimum price of the insurance premium is set at 100 CZK per individual SFD (or person at PK).
Amounts are rounded mathematically to whole crowns.
Liability insurance does not apply to any harmful events occurring in the territory of the states and regions listed below (hereinafter also referred to as "excluded territories"):

a) Algeria, Burundi, Far North (region in Cameroon), Central African Republic, Democratic Republic of Congo, Ethiopia, Kenya, Mali, Mauritania, Nigeria, Somalia, Republic of Sudan, South Sudan,
b) Colombia, Peru
c) Afghanistan, Jammu and Kashmir (Union State in India), North Korea, Pakistan
d) Abkhazia, Donetsk & Lugansk (regions in Ukraine), Nagorno-Karabakh, North Caucasus Federal District (region of Russia), South Ossetia,
e) Iran, Iraq, Lebanon, Libya, North Sinai including the international airport in Taba (province in Egypt), Syria, Yemen,
f) Any State in whose territory the operation of an aircraft is in violation of United Nations sanctions.

Furthermore, it is agreed that exclusively for the type of aircraft Paraglider and Paraglider - tandem, the insurance is provided in deviation from letters a) and b), point 4.1, part B, article II. also applies to insurance events occurring in the territory of COLOMBIA and KENYA.
Under the conditions:
– Aircraft Type: Paraglider/ Paraglider – Tandem
– Insured amount of insurance benefit of EUR 1,5 million
– Insurance including clause AVN52e
- Transport across the Atlantic - the paraglider will be carried on the plane as oversized luggage.

Insurance does not apply for damages claimed under aircraft operating liability insurance, additional passenger liability insurance, if the damage occurs in the Defined Territory (as defined below) and/or if such damage occurs by virtue of or in connection with armed conflict between Russia and Ukraine. However, this exclusion does not apply to aircraft which are neither heading to nor leaving the Defined Area, but which have landed in the Defined Area solely due to direct force majeure.

"Defined territory" includes:
(a) Republic of Belarus
(b) the Russian Federation (to the extent recognized by the United Nations) or its territories, including territorial waters, or protectorates over which it has legal control (legal control means where it is recognized by the United Nations); or
(c) Ukraine (in accordance with the borders established under LA 1991 Declaration of Independence, including the Crimean Peninsula and the Donetsk and Luhansk Oblasts).
Despite the provisions of the previous paragraph, the liability insurance for damage agreed with a territorial scope on the territory of the whole world applies to:
a) adverse events occurring in connection with the overflight of any excluded territory, provided that the flight is conducted in an internationally recognized air corridor and is conducted in accordance with the recommendations of the International Civil Aviation Organization (ICAO), or
b) harmful events occurring in connection with cases where the aircraft landed in the excluded territory in direct connection and exclusively as a result of force majeure.
Conditions for processing policies:
  • ONLINE (www.laacr.cz) (after that you no longer send a paper application).
  • Filling in the insurance application and delivering it to the LAA in person, by post (the paper application is printed in the December Bulletin of the LAA ČR), or by e-mail to the address sormova@laacr.cz (for SFD with registration mark) or tinakova@laacr.cz (for paragliders).
  • Payment of the insurance amount (the amount is considered paid if it is credited to the LAA account, paid by money order at the post office or paid in cash at the LAA cash desk). The insurance policy is valid no earlier than the day after the payment of the insurance amount.
